PROVISION OF SERVICES
You are agreeing to contract Ed Stivala Limited for the purposes of an exercise programme to improve your fitness. You agree to pay for the services at the agreed rate; either monthly or per session.
You agree that you have read, understood and completed the PAR-Q. All questions have been answered to the best of your knowledge.
INFORMED CONSENT
The purpose of an exercise programme is to help you to achieve health and fitness goals. Your programme will be based upon your present activity / exercise levels and the goals that you wish to achieve. You will experience some feelings of exertion during each activity session and will become hot and uncomfortable at times. Your breathing and heart rate will increase as a result of these activities as would be expected from physical exercise of this type. As your fitness improves, you will participate in more vigorous levels of activity, if this is part of your goal. Activities will be appropriately explained and demonstrated to you but please feel free to ask questions about anything you are unclear about.
Any exercise programme carries with it an element of risk. Your sessions are designed to minimize the risks whilst providing an effective exercise/activity programme. Please inform your Coach if, for any reason (such as illness or injury which might be aggravated by exercise), you should not participate in an activity.
During training sessions with your Coach present you will be closely supervised. During training sessions where your Coach is not present you will be responsible for your own safety. If, at any time, you feel undue pain or excessive discomfort stop the activity and inform your Coach (if present) or medical professional of your symptoms.
ONLINE & REMOTE COACHING
As with any fitness and exercise programme, when using online content and video you need to use your common sense. If you are feeling unwell do not exercice. To reduce and avoid injury, you should check with your Doctor before beginning any fitness programme. By performing a fitness exercise without supervision (which is the case for Online & Remote Coaching), you are performing them at your own risk. Ed Stivala (or Ed Stivala Limited) will not be responsible or liable for any injury or harm you sustain as a result of an online fitness programme, DVD, digital materials, online fitness video or information shared on our website or via mobile applications. This includes emails, video and text.
It is your responsibility to ensure that:
- there is sufficient space to perform the exercises safely and move freely without obstacles or obstructions, free from furniture, equipment and other hazards – a minimum of four square metres per person
- any equipment is safe and in a suitable condition for the activity being performed
- the surrounding floor space is entirely clear to remove any hazards that may increase the risk of slips, trips or falls
- there are no distractions throughout the duration of the session
- there is sufficient heating, lighting, ventilation and hydration.
PARTICIPATION
You are free to withdraw from any activity at any time you wish.
Participation in the programme described to you by your Coach is entirely at your choice. The nature, purpose, risks and benefits will be explained to you so that you understand what is required. If you are not sure of any aspect of your programme you are encouraged to ask questions before attempting an activity/session or exercise. You may stop at any time.
PAYMENT
Payment must be made in advance and can be made by Major Credit and Debit Cards, BACS or Online transfer. Cheques should be made payable to “Ed Stivala Limited”.
For rolling monthly agreements, payment should be made by Digital Subscription or Standing Order and received by Ed Stivala Limited on or before the 1st of the month to which they apply.
When purchasing a physical product. we will not process your order and draw on your funds until your goods are ready for dispatch. We reserve the right to refuse a sale up until this point.
Credit Card Security
When you purchasing services or products online at EdStivala.com, your credit card details, name and address are not handled directly and are processed securely through Stripe.
All credit/debit card payments are handled through a secure payment provider (Stripe) and dealt with at the highest possible levels of security.
When you are on a secure part of our site, you will see the ‘golden padlock’ icon in your browser, which confirms that any information you send will be in a secure format. You will see that the vast majority of pages are ‘secure’, even though you are not sending any data.
Product Delivery Schedule
Orders place on the EdStivala.com website before 12 noon (GMT) will be despatched the same day, subject to stock availability. Please note all orders placed during a weekend or Bank Holiday will be processed and despatched on the next available working day. We do not offer a guarantee of this however and during busy times orders may take longer to be dispatched and reach you.
Product Back Orders
If your item is not in stock, we will place it on back order for you. You will always be emailed with the option to cancel your order if you would rather not wait.
Guarantee
Your satisfaction with our products and services is of the utmost importance to us.
All of our products come with a 14-day no quibble guarantee (see ‘Returns Policy’ for details). If for any reason you are not satisfied with your purchase, return your product(s) in original condition and you will be refunded.
If a service does not meet your expectations, you should raise this at the time with your coach. Or, contact us in writing (email) within 24 hours of your session. Our no quibble guarantee extends to all coaching services and, subject to you notifying us with in 24 hours, you will receive a full refund for the session in question.
SESSION CANCELLATION
Once a booking has been made (payment sent), 24 hours notice is required for cancellation. Cancelling with more than 24 hours notice will entitle you to a full refund or at your discretion (and subject to availability) the rescheduling of your session to an alternative date.
Where fees are paid on a monthly basis, this agreement can be cancelled by either party on seven days notice and will then terminate at the end of the currently pre-paid period. Strictly by mutual agreement, the notice period can be changed or waived.
Product Returns Policy
EdStivala.com’s guarantee means that if for any reason you are unhappy with your product purchase, you can return it to us in its original condition within 14 days of the date you received the item. Send the item(s) unopened (with any seals and shrink-wrap intact) and we will issue a full refund for the price you paid for the item(s). Please note: we can only refund you for unopened and unused items. Any missing or used items will remain chargeable.
Also, we cannot accept responsibility for the cost of your return to us. We do recommend that you return any faulty/unwanted items by guaranteed recorded post. We cannot accept responsibility for returned items that go astray in the mail.

ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between you and Ed Stivala Limited. It supersedes all other prior agreements, understandings, representations and warranties, both written and oral, between you and Ed Stivala Limited, with respect to any aspect of training, coaching, exercise programmes or supply of fitness related products.
